BILL OF LADING PREPARATION:
- “Shipped To” information must include complete name of consignee, street address, zip code and telephone number.
- If billing address is different than “Shipped To” address for prepaid shipments, include delivery address and/or drop point instructions in the space provided.
- “Shipping Date” is to be actual date shipment in tendered to CARRIER.
- Include actual outside dimension of boxes for plants, nursery stocks and other miscellaneous shipments.
- “Quantity” should be the actual number of units tendered for shipment. When one or more boxes are tied together, that bundle will be considered as one unit. Note: For your protection also enter the number of boxes by type in the underscored description area.
- Type or print all information and make certain all copies are legible.
LIMITS OF LIABILITY:
Limit of loss for damage and/or shortage for less than truckload (LTL) shipments is limited to the lessor of actual invoice amount of damages, or $75.00 per box.
FINANCIAL TERMS AND CONDITIONS OF FREIGHT CHARGES:
- Freight charges are payable in cash at the time shipment is tendered to CARRIER except when shipper/consignee has established credit with CARRIER.
- Freight charges for credit shipping is assumed to be on a prepaid basis unless the account has been approved by CARRIER as a collect freight account.
- Credit terms for authorized credit accounts are fifteen (15) days from shipping date. Payments not received within this period may be subject to a service charge.
- CARRIER will not process or be held responsible for COD shipments. COD terms must be arranged directly with the destination agent.
- Freight charges are predicted on presentation and departure from CARRIER’S terminals to be given schedule drop point, which may be other than the designated consignee’s address. Any charges for local delivery to the CARRIER’S terminal or destination handling and redelivery are the responsibility of the shipper/consignee and may be added to CARRIER’S invoice for freight charges. Neither origin or destination drayage charges may be advanced on this bill of lading without prior approval by CARRIER.
- A single shipment processed on a bill of lading is subject to a minimum charge.
CONDITIONS OF TRANSPORTATION:
- Transport temperature is 37 degrees Fahrenheit (+-4 degrees). There is no warranty that this cargo hold-temperature can penetrate or be maintained in any portion of any shipment. Any merchandise tendered is represented by the shipper/consignee to be tolerant of this temperature.
- CARRIER shall not be liable for loss, damage or delay due to Acts of God, the Public Enemy, the Authority of the Law and other factors beyond CARRIER’S control.
- CARRIER shall not be liable and will not be bound by any particular schedule other than reasonable dispatch.
- All shipments are accepted on the condition that delivery can be made upon arrival regardless of the day or time of arrival. Rights to delivery receipts are waived where twenty-four (24) hour dock arrangements at delivery drop points have been made through lock box and other free entry arrangements.
- Any delivery that is refused upon arrival, for any reason, may be transported to the nearest point of distribution for disposition at the expense of the shipper. A delivery that is delayed at the convenience of the receiver may be subjected to demurrage charges.
- A cargo or portion thereof that is detained or refused at the border due to shipper failure to have compiled with current quarantine, customs, or other entry requirements may be delivered to the nearest public warehouse, with admission and storage charges referred to shipper or agent. Freight charges will not be waived.
- Carton integrity is the responsibility of the shipper/consignee. Damage due to carton collapse, or product upset and jumbling, unless occurring where preventive measures in packaging have been employed and shown to be normally effective, will be the responsibility of the shipper/consignee. Shipping containers which leak moisture will be refused and leakage in transit will nullify carrier liability. Unsealed, unstapled, tucked in, sliding telescope or open topped cartons which may permit pilferage or damage by intrusion of objects will be transported at shipper’s risk and may be declined.
- Any single unit of a shipment exceeding 60 pounds may be excluded from any coordinated movement or accepted subject to space availability and will subject to a surcharge.
- CARRIER must be notified within 24 hours following the delivery of any pending or potential claim involving shortage, damage or any other irregularity and all claims must be filed within 30 days. No claim for damage shall be considered until the transportation charges have been paid. CARRIER reserves the right to direct salvage disposition. Itemized copies of invoices, proof of degree and possible cause of damage, and the percent of salvage achieved and/or attempted will be required to support any claim. An inspection report, supplied by a qualified and non-involved person or agency will be required for damaged product exceeding $500.00, and should be obtained in proper time to substantiate a claim.
- SHIPPER is to tender product to CARRIER at a proper temperature.
- When boxes are tendered at a temperature above 50 degrees Fahrenheit the shipping vendor will immediately be notified. The shipping vendor will be given the opportunity to pre-cool the box to an acceptable transportable temperature within the time frame allotted for on-time departures at their own expense. As a result, we may refuse to transport individual boxes of product if the temperature after pre-cooling exceeds 50 degrees Fahrenheit at the time of their scheduled departure.
